One of our specialties, and one of the most important factors in beginning to evaluate a Long Term Care case involves rigorous screening of potential Nursing Home/Assisted Living Facility claims as well as standard of care evaluation in areas of negligence and/or malpractice unique to Long Term Care.
The majority of cases involving Long Term Care or assisted living facilities revolve around the development of pressure ulcers, falls, pain management, medication deviations, infections, and nutritional/hydration issues. However, all aspects of the care provided by a facility can be targeted in claims of negligence or malpractice, making experience in this area even more important when reviewing the medical records from a long term care facility. Basic care principles such as turning and repositioning, assistance with activities of daily living (ADL), and medication administration policies and practices are often called into question as well as comprehensive resident assessments and significant changes in a resident’s condition.
The knowledge of ALN’s consulting team of federal and state guidelines put forth by the Centers for Medicare and Medicaid Services (CMS) and the Department of Health and Hospitals (DHH), as well as standards of care and implementation of the nursing process in the provision of resident care, can make the difference in the outcome of cases involving nursing homes. Familiarity with documentation specific to this area of care such as minimum data set (MDS) assessments and interim and comprehensive plans of care, as well as resident specific risk assessments, can be very important in determining or refuting liability issues.
